Title IX Definitions
Below is a list of typical definitions related to Title IX and the university’s Sexual Harassment & Misconduct Policy. See the Policy for more details.
Complainant: An individual alleged to be the victim of conduct that could constitute harassment, misconduct, or retaliation under the University’s policy.
Formal Complaint: A document submitted or signed by the complainant or the Title IX Coordinator alleging harassment, misconduct, or retaliation (under the University’s policy) that initiates an investigation.
Consent: Defined by the University as clear, voluntary, informed permission that cannot result from force, coercion, or incapacitation.
Confidential Resources: Individuals or offices that can receive disclosures of misconduct without mandatory reporting obligations.
Day: A business day when the University is operating routinely. It does not include weekends or holidays when university normally operating offices are closed.
Education Program or Activity: Locations or contexts where the University exercises substantial control over involved parties and circumstances.
Finding: Determination of whether the alleged conduct occurred, based on the preponderance of evidence.
Final Determination: Conclusion of whether University policy was violated.
Grievance Process (Formal): The University’s formal resolution method compliant with federal regulations.
Hearing Officer / Facilitator: A member of the Hearing Panel that facilitates the Hearing portion of the Grievance Process. They make decisions during the hearing regarding the process, including questions of relevancy and a final determination of whether Prohibited Conduct occurred, and potential Sanctions associated with such Prohibited Conduct.
Investigator: Individual responsible for gathering facts, assessing credibility, and compiling the report.
Party: A Complainant or Respondent. The term “Party” does not include a Title IX Coordinator who initiates a Complaint under § 106.44(f)(1)(v) or another participant in Title IX Grievance Procedures, such as a witness or adjudicator.
Respondent: The person alleged to have engaged in prohibited conduct.
Supportive Measures: Individualized services to preserve equal educational access without burdening either party.
